• GSL General Terms and Conditions

    The terms and conditions described below establish the framework for the commercial relationship between the participant and GSL, the provider and organizer of adventure travel programs. Please read the following paragraphs carefully. It is assumed that the participant is familiar with and fully accepts and complies with the terms and conditions mentioned below.

    1. Formation of a Contract

    A travel contract is established when an individual registers for one of our travel programs, either in writing, over the phone, or in person, through an authorized travel agent or directly with GSL.

    For travels with GSL, the general terms and conditions, and, under specific circumstances, the signed forms related to travels with particular risks (such as medical questionnaires/waivers) become integral parts of the contract.

    2. Prices and Payment Terms
    2.1. Prices

    The current prices for our travel offerings can be found on our website at gulmargsnowleopards.com. Prices are quoted in British Pounds and are per person, based on double room accommodation. For single rooms, an additional surcharge, as communicated, is applicable. Single accommodations must be requested and booked at the time of reservation. The price for the booked travel program must be paid in advance according to the following terms:

    2.2. Deposit Payment

    A minimum deposit of GBP 300 per participant is required at the time of booking. Some hotels may require full payment upfront. If the deposit is not paid at the time of booking, it must be made within 48 hours of receiving the invoice. Reservations are not confirmed until the deposit is received. 100% of the total package cost must be paid 60 days prior to the package's start date.

    2.3. Final Payment

    The remaining balance or pending payment must be received at least 60 days prior to the package's start date. Otherwise, GSL reserves the right to cancel the booking without notice and apply the cancellation fee, with no recourse for the participant. For bookings made 60 days or less prior to the departure date, full payment is due at the time of reservation.

    2.4. Payment options

    We offer these payment options:

    Payment via a paylink with Visa, Mastercard, Apple Pay or Google Pay

    Acceptance of payments in GBP, EUR, or USD

    Bank transfer to our UK-based IBAN bank account.

    IMPORTANT! For bank transfers, participants are responsible for covering all bank fees, transfer fees, etc. Please ensure that you instruct your bank to choose "All charges are borne by the remitter" when sending or transferring your payment, including any charges and fees imposed by the receiving bank. GSL must receive the entire invoice amount in full. Any unpaid amounts must be settled upon arrival.

    2.5. Late Payment

    If payments are not made within the specified deadlines, GSL reserves the right to refuse the provision of services and charge the cancellation fees specified in section 5.2.

    2.6. Single Room Occupancy Surcharge

    Our partner hotels only offer double rooms and bill us separately for single occupancy. Therefore, single guests and groups traveling with an odd number of participants will incur the single room occupancy surcharge as indicated in our programs.

    2.7. Small Group Surcharge

    No small group surcharge is applicable for our programs.

    3. Program Cancellation by GSL
    3.1. Minimum Number of Participants

    Unless specified otherwise, there is no minimum number of participants required. However, if only a limited number of people participate, GSL is entitled to either cancel the program 15 days before departure or request a surcharge. In the event of program cancellation by GSL, all payments made will be refunded, minus bank transfer fees, handling fees, or other associated charges. Further services provided by GSL will not be available.

    3.2. Other Reasons

    In the event of program cancellation due to other reasons, such as Acts of God, political unrest, strikes, pandemics, catastrophes, or other factors that could jeopardize a safe trip, a cancellation may occur on short notice. In such cases, payments received will be refunded, but GSL is entitled to deduct any expenses already incurred for the program. Additional claims for compensation are not applicable.

    4. Price and Program Changes, Surcharges during the Travel Program
    4.1. Price Changes

    GSL's travel programs require substantial advance planning and organization. Consequently, price changes may occur for reasons including:

    Subsequent price increases by transportation companies (e.g., fuel, taxes, etc.).
    Newly introduced or increased state duties and charges (e.g., VAT, airport tax, etc.).
    Exchange rate fluctuations.

    GSL must communicate price changes at least 40 days before the departure date. If the price increase exceeds 10% of the initially communicated price, participants have the option to terminate the contract within 5 days after receiving the information about the price increase.

    4.2. Supplementary Costs during the Journey

    Supplementary costs resulting from unforeseen events beyond GSL's control are the responsibility of the traveler.

    4.3. Program Modifications

    The travel program or its components (such as accommodation, means of transport, airlines, and schedules) may be altered before or during the trip due to unforeseen circumstances. Please also refer to the terms for travels with specific risks. If a significant portion of the services is not provided, GSL will refund the difference between the total program cost and the cost of the services that were not delivered, provided that GSL is not billed for these services by a third party. Further claims for compensation are excluded.

    5. Terms for Program Cancellation and Modification
    5.1. General

    If a participant wishes to cancel, change, or modify their bookings, they must inform GSL in person or in writing.

    5.2. Cancellation Fees

    All cancellations must be communicated to GSL by email and registered letter. Travel documents must be returned to GSL at the same time.

    Cancellation fees will be charged by GSL for any cancellation requested by the traveler, regardless of the cause, including but not limited to fear of political unrest, acts of terrorism, natural disasters, Acts of God, or personal reasons.

    The following cancellation fees apply:

    45 days or more prior to departure: The deposit is non-refundable. If the deposit exceeds the total deposit, GSL will transfer the difference to your bank account. All bank transfer fees, handling fees, or other associated fees will be the participant's responsibility. Deposits paid by one participant are not transferable to another participant within the same group or a new group.
    Less than 45 days prior to departure: The total package price is due and non-refundable. Participants who do not appear, arrive late, or travel without the necessary travel documents at the airport agree to pay GSL the full 100% value of the package price.
    Late Arrival: If a passenger cannot travel on the booked departure date or time or arrives late at Srinagar Airport without notifying GSL, a fee will be charged for the shuttle service from Srinagar Airport if the shuttle has to return to the airport a second time. If you arrive one or more days after the scheduled arrival date (for reasons beyond GSL's control), there will be no refund for any of the paid services. No refunds will be granted for unused or canceled packages or services after your booked departure date or due to circumstances beyond GSL's control. Regardless of the reason for early trip termination (illness, personal reasons, etc.), the unfinished portion of the trip is non-refundable.

    6. Travel Insurance

    It is the participant's responsibility to ensure they have appropriate insurance coverage. Our travel programs involve sports and adventure activities primarily conducted outdoors. Participants are aware of the associated risks and voluntarily participate at their own risk. Participants must verify if their insurance covers program cancellation, evacuation, accidents, illness, and an untimely return trip. They must supplement their existing insurance with any missing components before the trip.

    7. Untimely Termination of the Program by the Participant

    If a participant terminates the program before completion for any reason, GSL is not obligated to refund the program price. Refer to section 5.3 regarding the mandatory travel insurance to cover potential costs.

    8. Immigration, Travel and Health Regulations

    GSL will inform participants about the existing regulations in our program descriptions. Participants are fully responsible for complying with immigration, visa, and currency exchange regulations. Participants should ensure they possess all necessary documents before departure and throughout the program. Failure to participate in the program or enter the destination country due to the lack of required documents will result in consequences borne solely by the participant.

    9. Liability of GSL

    GSL disclaims all responsibility for accidents, physical injuries, or other damages occurring during the execution of the travel program. GSL is not liable for damages resulting from participant or GSL fault, omission, or negligence that could disrupt or hinder program execution. GSL is not responsible for damages caused to participants by third parties involved in program execution. The terms specified in the "GSL Waiver" are applicable to all our Heli Skiing and Powder Snow Programs.

    10. Obligation to Co-Operate, Notice of Defects

    Participants are obligated to take action to address any detected deficiencies in the program to avoid or mitigate potential damages. Any complaints during the trip must be immediately reported to GSL or its local representative. This is a prerequisite for future damage claims. Most deficiencies can typically be rectified on the spot. Complaints, along with confirmation from the GSL program leader or local representative, must be submitted in writing via registered letter to GSL. Failure to meet these terms and deadlines will result in the expiration of all damage claims.

    11. Exclusion from the Travel Program

    Participants in GSL travel programs spend significant time together in a group. Therefore, GSL reserves the right to exclude group members before or during the travel program if there are concerns about negative impacts on the group, disturbance to the program, or putting the group in danger. The same applies if participants disrupt the proposed program execution. If participants are excluded from the travel program, GSL is entitled to apply the cancellation fees and service charges described in section 5. No refund will be provided if participants are excluded during the program. Refer to the previously mentioned forms for travels with specific risks.

    12. Tips

    Tips for local guides, drivers, porters, etc., are not included in the program price.

    13. Applicable Law

    Unless specified otherwise, English law applies to the legal relationships between participants and GSL. All claims for compensation become time-barred one year after the provision of the service.
